DocPouch – Website & Ordering Platform Terms and Conditions

1. Agreement
These Terms and Conditions (“Terms”), together with our Privacy Policy (collectively, the “Agreement”), govern your access to and use of the DocPouch website and ordering platform (the “Platform”).
By accessing, browsing, registering for, or using the Platform (including submitting an order request), you agree to be bound by this
Agreement. If you do not agree, you must not use the Platform.
We may amend these Terms at any time by publishing updated Terms on the Platform. Your continued use after changes are published
constitutes acceptance of the updated Terms.
2. Definitions and Interpretation
In this Agreement:
“ACL” means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
“Approved Pharmacy” / “Supplying Pharmacy” means Priceline Pharmacy Sunshine Marketplace (or any replacement partner pharmacy notified on the Platform from time to time).
“Business Day” means Monday to Friday, excluding public holidays in Victoria, Australia.
“Clinic Account” means an account created for a medical practice that may manage multiple prescribers under one clinic profile.
“PBS Prescriber Bag” / “Prescriber Bag” means the PBS prescriber bag supply arrangements and related legislative instruments and determinations.
“Order” means (as applicable) a PBS Prescriber Bag order request submitted via the Platform.
“Order Form” means the Prescriber Bag Supply Order Form required under PBS Prescriber Bag arrangements.
“You” / “User” means the person or entity accessing or using the Platform, including where relevant a practice manager acting on behalf of a prescriber or clinic.
Headings are for convenience only and do not affect interpretation.
3. About DocPouch and the Platform
DocPouch is an administrative workflow platform designed to help eligible Australian prescribers and clinics prepare, submit, and track: PBS Prescriber Bag order requests
DocPouch does not dispense medicines. All dispensing, supply decisions, and fulfilment are performed by the Supplying Pharmacy in
accordance with applicable law, PBS requirements, professional standards, and
commercial viability.

4. Eligibility and Intended Users
Use of the Platform is strictly limited to:
- AHPRA-registered medical practitioners and authorised prescribers eligible under PBS rules;
and/or - authorised practice managers or clinic representatives acting on behalf of such prescribers.
The Platform is not intended for consumers or patients. We may refuse access, suspend accounts, or cancel Orders if we reasonably
believe you are not an intended user.
5. Account Registration, Clinic Accounts, and Verification
5.1 Account creation
To place or submit an Order, you must create an account and provide accurate, complete, and current details, which may include:
- Full legal name
- Email and password
- AHPRA registration number
- Prescriber number (where applicable)
- Clinic name, address, and contact details
- Practice manager details (if ordering on behalf of prescribers)
5.2 Clinic Accounts and multiple prescribers
Where enabled, a Clinic Account may allow a practice manager to manage Orders for multiple prescribers. Each prescriber remains
individually responsible for compliance and may require separate verification.
5.3 Verification and approval
Accounts and Orders may be subject to verification (manual or automated). You authorise us and the Supplying Pharmacy to verify your identity, registration, and eligibility using publicly available registers and/or reasonable documentation requests.
Orders may be drafted or submitted, but no supply occurs until verification is completed and the Supplying Pharmacy approves the Order.
5.4 Security of credentials
You are responsible for maintaining confidentiality of your login credentials and for all activity occurring under your account.
Notify us immediately if you suspect unauthorised access.
6. Acceptable Use and Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose
- Misrepresent your identity, registration, prescriber number, or clinic details
- Attempt to access another user’s account or data
- Upload malicious code, interfere with security, or disrupt the Platform
- Scrape, copy, or harvest content or data from the Platform without permission
- Use the Platform to request supply inconsistent with PBS rules, professional standards, or pharmacy policy
We may suspend or terminate access without notice if we reasonably believe you have breached this section.
7. Platform Availability and Changes
We do not guarantee the Platform will be available at all times or free from errors. We may change, suspend, or discontinue any aspect of the Platform at any time.
8. Nature of Orders (No Guaranteed Supply)
8.1 PBS Prescriber Bag Orders (no sale)
Submitting a PBS Prescriber Bag Order via the Platform is an administrative request and is not a retail purchase.
Submission:
- Does not form a contract of sale with DocPouch
- Does not guarantee supply
- Does not obligate the Supplying Pharmacy to dispense or supply medicines
All PBS Prescriber Bag Orders remain subject to PBS requirements, verification, stock availability, and pharmacy discretion.
9. PBS Compliance Responsibilities
You acknowledge PBS Prescriber Bag arrangements include (among other requirements):
- Items are for emergency/urgent patient use
- Monthly quantity limits apply
- Stockpiling is not permitted
- Correct completion and handling of Order Forms is required
You are solely responsible for compliance with PBS requirements, including ensuring you are eligible and that requests are
appropriate.
10. Order Forms and Documentation
10.1 Uploading Order Forms (mandatory for PBS)
PBS Prescriber Bag Orders require a signed Order Form.
The Platform may require upload (PDF/JPG/PNG) before allowing submission for review.
10.2 Posting originals (legal authority)
Uploading a copy supports review but does not replace the legal requirement to provide original documentation as required under PBS rules.

If documentation is missing, incorrect, illegible, incomplete, or inconsistent, the Supplying Pharmacy may place the Order On Hold or decline it.
10.3 Audit trail and retention
You acknowledge the Platform may store uploaded copies, order history, and related metadata to support verification and audit
readiness. Retention periods are described in the Privacy Policy and may be extended where required by law, PBS requirements, or legitimate compliance purposes.
11. Pricing, Payments, and Fees
11.1 PBS Prescriber Bag
PBS Prescriber Bag items are supplied in accordance with PBS arrangements and are generally provided without charge to eligible
prescribers (subject to approval and compliance). No payment is taken for PBS
Prescriber Bag items through the Platform.
11.2 Payment providers
Payments may be processed by third-party providers such as Stripe and may support Apple Pay, Google Pay, and card payments. You agree to the provider’s terms as applicable.
DocPouch and/or the Supplying Pharmacy do not store full payment card details.
11.3 Chargebacks and disputed payments
If you initiate a chargeback or payment dispute for a Stock Order:
- We may suspend your account pending investigation
- We may request supporting documentation
- You remain responsible for amounts legitimately owed, including fees incurred due to wrongful
chargebacks, to the extent permitted by law
11.4 Fraud and security checks
We may refuse, cancel, or hold Private Stock Orders where fraud, misuse, or verification issues are suspected.
12. Pharmacy Discretion, Substitution, and Commercial Sustainability
The Supplying Pharmacy may approve, partially fulfil, substitute, delay, or decline any Order where:
- PBS rules do not permit supply
- Verification is incomplete or inconsistent
- Stock is unavailable
- Supply would create professional, legal, or regulatory risk
- Supply would be commercially unsustainable
You acknowledge that the Supplying Pharmacy purchases, dispenses, and ships medicines at cost and is not required to supply medicines at a loss or where reimbursement/commercial conditions make supply unviable.
13. Dispatch, Delivery, and Risk
13.1 Dispatch and tracking
Where an Order is approved and supplied, dispatch and tracking may be provided. Dispatch cut-offs are indicative only and may vary due to workload, verification timing, stock constraints, and courier constraints.
13.2 Delivery conditions
Delivery may require signature and may only be delivered to the verified clinic address or another address approved by the Supplying
Pharmacy. You are responsible for ensuring someone is available to receive
delivery where required.
13.3 Risk after dispatch
To the maximum extent permitted by law, the Supplying Pharmacy is not responsible for delays or failures caused by couriers or events outside reasonable control once dispatched, except where required by law.
13.4 Cold chain / temperature-sensitive items
Where temperature-sensitive items are shipped, reasonable measures may be used (e.g., insulated packaging, monitoring where available). You are responsible for promptly receiving and correctly storing such items on
delivery. If you suspect a cold chain breach, contact the Supplying Pharmacy
immediately.
14. Returns, Refunds, and Complaints
14.1 PBS Prescriber Bag
Due to the nature of medicines and regulatory requirements, returns are generally not accepted except where required by law or where the Supplying Pharmacy determines replacement is appropriate (e.g., damaged in transit, incorrect supply).
14.2 Reporting issues
You must inspect deliveries promptly and report damage, discrepancies, or issues within 24 hours of delivery (or as soon as reasonably practicable).
15. Medical and Information Disclaimer
The Platform content is for general administrative guidance only. It does not constitute medical, prescribing, legal, or PBS
entitlement advice. You must rely on your own professional judgment and official PBS/Services Australia publications.
16. Australian Consumer Law
Nothing in this Agreement excludes, restricts, or modifies any rights or remedies you may have under the ACL or other laws that cannot be excluded.
To the maximum extent permitted by law, and where the ACL does not apply (including where you acquire services as a business user), we exclude all other warranties and guarantees.
17. Limitation of Liability
To the maximum extent permitted by law:
- DocPouch and the Supplying Pharmacy are not liable for indirect, incidental, special, or consequential loss (including loss of profit, revenue, goodwill, or opportunity) arising from use of the Platform or any Order.
- We do not guarantee uninterrupted access, verification timeframes, stock availability, PBS eligibility outcomes, or supply.
- Our liability for any claim relating to the Platform is limited to resupplying the relevant services or paying the cost of resupplying those services, to the extent permitted by law.
Where Private Stock is purchased, any liability relating to the purchase is limited to the amount paid for that Private Stock Order, to the extent permitted by law.
18. Indemnity
You agree to indemnify and hold harmless DocPouch and the Supplying Pharmacy (including their officers, employees, contractors, and agents) against losses, claims, liabilities, costs, and expenses arising from:
- Your breach of this Agreement
- Inaccurate or misleading information you provide
- Misuse of the Platform
- PBS non-compliance attributable to your conduct
- Unauthorised access or action performed under your account
19. Privacy and Data Security
We handle personal and professional information in accordance with Australian privacy laws and our Privacy Policy.
You acknowledge that no online system is perfectly secure and you use the Platform at your own risk, although we implement reasonable safeguards.
20. Intellectual Property
All Platform content, branding, and underlying software (including layout, text, design, and functionality) is owned or licensed by DocPouch. You must not copy, reproduce, publish, distribute, or exploit.
Platform content except as permitted by law or with prior written consent.
21. Third-Party Links
The Platform may contain links to third-party websites. Those links are provided for convenience only. We are not responsible for
third-party sites, content, availability, or privacy practices.
22. Suspension and Termination
We may suspend or terminate your access without notice
if:
- We suspect misuse, fraud, or unlawful activity
- Verification fails
- You breach these Terms
- Continued access creates compliance, safety, or commercial risk
Termination does not affect accrued rights or obligations.
23. Force Majeure
We are not liable for failure or delay caused by events outside reasonable control, including supplier shortages, wholesaler
constraints, courier disruptions, system outages, natural disasters, or regulatory changes.
24. Notices and Contact
Platform support and pharmacy contact details may be listed on the Platform.

25. General
- If any provision is unenforceable, it will be severed and the rest remains in force.
- No waiver is effective unless in writing.
- You must not assign your rights under this Agreement without our consent.
- This Agreement constitutes the entire agreement between you and us in relation to the Platform.
26. Governing Law
These Terms are governed by the laws of Victoria,
Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
